Nationwide appealed this conclusion, and Choose Realized Hand declared in 1952 that Nationwide's Superman copyright was in fact legitimate. Choose Hand did not find that the character of Captain Marvel itself was an infringement, but rather that distinct tales or Tremendous feats can be infringements, which must be established inside of a retrial.
